2. Applicability
1. These terms and conditions apply to all offers, orders, and agreements between Hobo Parts Brakel and consumers.
2. By placing an order, the consumer agrees to these terms and conditions.
3. Deviations are only valid if confirmed in writing.
3. Offers and Agreement
1. All offers and quotations are non-binding and may be changed at any time.
2. The agreement is concluded once the consumer places an order and Hobo Parts Brakel confirms it.
3. If an offer or price contains an obvious error, such as a typographical mistake, Hobo Parts Brakel reserves the right to correct it.
4. Prices and Payment
1. All prices are stated in euros and include VAT and other applicable taxes.
2. Payment must be made through the payment methods offered on the website.
3. The price at the time of ordering is binding.
5. Delivery and Shipment
1. Stock items: shipped within 1 business day for orders placed before 16:00.
2. External stock items: shipped within 2 business days for orders placed before 16:00.
3. Delivery times are indicative. If delivery is delayed, the consumer may cancel the contract free of charge.
4. The risk of loss or damage transfers to the consumer only upon delivery.
6. Right of Withdrawal and Returns
1. The consumer has the right to withdraw from the agreement within 14 days after receiving the product, without providing any reason.
2. During the cooling-off period, the consumer must handle the product and packaging with care.
3. To exercise the right of withdrawal, the consumer must notify Hobo Parts Brakel within the withdrawal period via email or the return form.
4. The consumer will be refunded the full purchase amount (including standard delivery costs) within 14 days after withdrawal, provided the product has been returned.
5. Return shipping costs are borne by the consumer, unless otherwise agreed.
6. Exceptions: the right of withdrawal does not apply to products made to the consumer’s specifications or clearly personalized.
7. Warranty and Conformity
1. Hobo Parts Brakel guarantees that the delivered products comply with the agreement and reasonable consumer expectations.
2. In addition to the statutory warranty, a manufacturer’s warranty may apply. This does not affect the consumer’s statutory rights.
3. Warranty does not apply in cases of:
- incorrect installation or misuse;
- normal wear and tear;
- damage caused by improper use.
8. Liability
1. Hobo Parts Brakel is liable for damages resulting from defective products to the extent provided by law.
2. Liability is limited to the purchase amount of the product concerned, unless caused by intent or gross negligence.
9. Privacy
Personal data are processed in accordance with the General Data Protection Regulation (GDPR). Please refer to our website for the privacy policy.
10. Force Majeure
Hobo Parts Brakel shall not be liable for delays or failures caused by circumstances beyond its control, such as natural disasters, strikes, or supplier disruptions.
11. Disputes and Applicable Law
1. These terms and agreements are governed exclusively by Dutch law.
2. Any disputes shall be submitted to the competent court in ’s-Hertogenbosch, the Netherlands.
